These Terms of Use (the “Terms”) govern your use of this website. By browsing or using the site, you accept them — please take a moment to read them before continuing.

Who we are and how these Terms work

Throughout these Terms, “the Practice”, “we”, “us” and “our” refer to Dubai Plastic Surgery — Dr. John M. Shamoun, MD FACS, of Emirates Specialty Hospital, Dubai Healthcare City, Dubai, United Arab Emirates. “You” refers to the person visiting or using this website, whether on your own behalf or for an organisation. “The Website” means dubaiplasticsurgery.com together with every page, feature and item of content made available through it, including for visitors researching Plastic Surgery in Dubai. An “Affiliate” is any entity that controls us, that we control, or that is under common control with us, where control means holding at least half of the voting ownership. Capitalised terms carry the meanings given here whether used in the singular or the plural. The “Country” for the purposes of these Terms is the United Arab Emirates, Emirate of Dubai.

Your agreement to these Terms

Using the Website constitutes your agreement to be bound by these Terms and by our Privacy Policy, which explains how we handle personal data and should be read alongside this page. If you do not accept any part of either document, please do not use the Website.

The Website is intended for adults. You confirm that you are at least 18 years of age; we do not offer the Website to minors.

Medical information — not advice

Content on this Website — including procedure descriptions, recovery guidance, articles and before-and-after imagery — is provided for general information only. It is not medical advice, does not create a doctor–patient relationship, and is no substitute for a personal consultation, examination and diagnosis by a qualified practitioner. Individual results differ; images of previous patients illustrate that patient’s outcome only and are not a promise of yours. Always seek the advice of an appropriately licensed clinician regarding any medical concern, and never delay seeking care because of something read here.

Third-party links

Pages on this Website may point to external sites or services that we neither own nor operate. We exercise no control over their content, policies or conduct, and accept no responsibility for them or for any loss connected with your use of them. Suspending or ending access

We may withdraw or suspend your access to the Website at once and without advance notice where we consider it necessary, including where these Terms have been breached. Any right you had to use the Website ends at that point.

Cap on our liability

To the fullest extent UAE law allows, our total liability (and that of our suppliers) arising out of these Terms or your use of the Website is capped at the greater of the amount you have actually paid through the Website and AED 350.

Likewise, to the fullest extent permitted, neither we nor our suppliers will be liable for indirect, incidental, special or consequential losses of any kind — among them lost profits, lost data, business interruption, personal injury or loss of privacy — connected with the Website or with third-party software or hardware used with it, even where we were told such losses were possible and even where a stated remedy fails of its essential purpose.

Nothing in this section excludes or restricts any liability that cannot lawfully be excluded or restricted under the mandatory provisions of UAE law; where such provisions apply, our liability is limited to the greatest extent the law permits.

The Website is provided “as is”

The Website is made available “as is” and “as available”, without warranties of any description. So far as the law allows, we — for ourselves, our Affiliates, and our respective licensors and service providers — disclaim every express, implied or statutory warranty, including implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and any warranty said to arise from dealing, performance or trade usage. We do not promise that the Website will satisfy your requirements, deliver any particular result, work with any other system or service, run without interruption or error, or that defects will be corrected.

Neither we nor any provider of ours warrants the operation or availability of the Website or its content; that it will be uninterrupted or error-free; that any information on it is accurate, reliable or current; or that the Website, its servers or any email sent on our behalf are free of viruses or other harmful code.

Where a jurisdiction’s law forbids excluding particular warranties or consumer rights, those exclusions apply to you only to the extent that law allows.

Governing law

These Terms, and your use of the Website, are governed by the federal laws of the United Arab Emirates together with, where applicable, the laws, regulations and rules of the Emirate of Dubai — including those applying to entities operating within Dubai Healthcare City — without regard to conflict-of-law principles. Other local, national or international laws may also apply to your use of the Website.

Resolving disputes

If something concerns you about the Website, contact us first — most matters can be resolved informally. Where that fails, the courts of the Emirate of Dubai, United Arab Emirates, have exclusive jurisdiction over the dispute.

Visitors from the European Union

If you use this Website as a consumer resident in the European Union, you keep the benefit of any mandatory protections of the law of your country of residence.

Compliance with UAE law and sanctions

You warrant that your use of the Website complies with the laws of the United Arab Emirates, and that you neither appear on, nor act for any person or entity appearing on, any applicable sanctions or restricted-parties list, including lists issued by the United Nations Security Council or by the competent UAE authorities.

Severability; no waiver

Should any provision of these Terms prove invalid or unenforceable, it is to be read in the way that best achieves its purpose within the law, and the rest of the Terms remain fully effective. If we do not enforce a right or obligation on one occasion, that does not prevent us from enforcing it later, and overlooking one breach does not excuse another.

Language

If we publish these Terms in translation, the English text prevails in any dispute to the extent the law permits.

Changes to these Terms

We may revise or replace these Terms at our discretion. For material changes we will make reasonable efforts to give at least 30 days’ notice before the new terms take effect; whether a change is material is for us to judge. Continuing to use the Website after revised Terms take effect means you accept them — if you do not, please stop using the Website.
